Secrecy invoked on Abramoff lawsuits

Administration Employs New Secrecy Defense in Lawsuits Over Abramoff's White House Visits

The Bush administration is laying out a new secrecy defense in an effort to end a court battle about the White House visits of now-imprisoned lobbyist Jack Abramoff.

The administration agreed last year to produce all responsive records about the visits "without redactions or claims of exemption," according to a court order.

But in a court filing Friday night, administration lawyers said that the Secret Service has identified a category of highly sensitive documents that might contain information sought in a lawsuit about Abramoff's trips to the White House.

The Justice Department, citing a Cold War-era court ruling, declared that the contents of the "Sensitive Security Records" cannot be publicly revealed even though they could show whether Abramoff made more visits to the White House than those already acknowledged.

"The simple act of doing so ... would reveal sensitive information about the methods used by the Secret Service to carry out its protective function," the Justice Department argued.

"This is an extraordinary development and it raises the specter that there were additional contacts with President Bush or other high White House officials that have yet to be disclosed," said Tom Fitton, president of Judicial Watch, a conservative watchdog group that filed the suit. "We've alleged that the government has committed misconduct in this litigation and frankly this is more fuel for that fire."

You just can make this up folks, once again this administration will go through amazing legal contortions to avoid providing the American people any accountability for their corrupt behavior.

Let’s see they can not give up the records showing when Jack visited because if they do then they will have revealed to the terrorists that they keep these kinds of records and that could prevent the secret service from protecting the President Crazy King.

Va. GOP drops loyalty-oath plan

Virginia's Republican Party on Friday abandoned a loyalty oath that would have required primary voters sign a pledge to back the party's nominee in the general election.

The party had been widely criticized for asking the State Board of Elections to put the oath in place for the Feb. 12 primary, which was meant to protect the contest from interference from outside the party. Opponents of the requirement warned it would drive away undecided voters. Virginia residents can vote for members of either party during their primary elections.

"We want to attract people to the Republican Party," said Jim Hyland, chairman of the Fairfax County Republican Committee. "The perception was that it was more of a closed-door policy, and we want an open-door policy."

You just have to love the reason they give for dropping the “oath”, come on let’s be honest, you dropped it because your fascist asses got called on the carpet for it.

Republicans Report Much Better Mental Health Than Others

PRINCETON, NJ -- Republicans are significantly more likely than Democrats or independents to rate their mental health as excellent, according to data from the last four November Gallup Health and Healthcare polls. Fifty-eight percent of Republicans report having excellent mental health, compared to 43% of independents and 38% of Democrats. This relationship between party identification and reports of excellent mental health persists even within categories of income, age, gender, church attendance, and education.

The delusion just runs really deep in the GOP, they’re freaking nuts and just don’t know it.

Witness Names to Be Withheld From Detainee

Defense lawyers preparing for the war crimes trial of a 21-year-old Guantánamo detainee have been ordered by a military judge not to tell their client — or anyone else — the identity of witnesses against him, newly released documents show.

The case of the detainee, Omar Ahmed Khadr, is being closely watched because it may be the first Guantánamo prosecution to go to trial, perhaps as soon as May.

Defense lawyers say military prosecutors have sought similar orders to keep the names of witnesses secret in other military commission cases, which have been a centerpiece of the Bush administration’s policies for detainees at Guantánamo Bay, Cuba.

Some legal experts and defense lawyers said the judge’s order, issued on Oct. 15 without public disclosure, underscored the gap between military commission procedures and traditional American rules that the accused has a right to a public trial and to confront the witnesses against him.

What’s so freaking hard to understand about the words “In all”! We dragged their asses to Guantánamo, we then have an obligation to use the processes we have in place to deal with them, not just make up new shit as it serves our current political need. This whole enemy combatant crap is so much bullshit, they are either POWs and should be treated as such(“we” claim we are in a “Global War on Terror”), our they must be tried for criminal behavior.

Shag-gate; The question that must be asked

Let’s make this really, really simple:

THE EX-MAYOR OF NEW YORK CITY, A LEADING GOP PRESIDENTIAL CANDIDATE, DEFRAUDED THE TAXPAYERS OF NEW YORK TO PROVIDE AID, COMFORT, AND TRANSPORTATION TO HIS MISTRESS.

I know that my shout-out above won’t fit on a bumper sticker, but fer chrissakes, from a news reporting standpoint it just doesn’t get any easier. There’s not much need to further flesh out the story. We don’t even need any more dirt. Giuliani should be smart enough to withdraw from the race on the merits of this incident alone, before indictments are handed up. If the allegation of his misuse of taxpayers funds doesn’t rate an investigation by the New York State Attorney General, I’d be very surprised.

The details are still simmering and approaching a low boil, but still, I sit here wondering:

What in the hell is it gonna take to wake up a legacy media that’s apparently slept through the last seven years?

Rudy needs to be asked the following question;

If you are elected President can the American public assume that at some point we will be paying for secret service protection for both the current Mrs. Giuliani (whoever that maybe at the time) and for your current mistress (whoever that maybe at the time)?

Dear Madam Speaker: (Mr. President:)

I am transmitting an alternative plan for locality pay increases payable to civilian Federal employees covered by the General Schedule (GS) and certain other pay systems in January 2008.

Under title 5, United States Code, civilian Federal employees covered by the GS and certain other pay systems would receive a two-part pay increase in January 2008: (1) a 2.5 percent across the-board adjustment in scheduled rates of basic pay derived from Employment Cost Index data on changes in the wages and salaries of private industry workers, and (2) locality pay adjustments averaging 12.5 percent based on Bureau of Labor Statistics salary surveys of non-Federal employers in each locality pay area. According to the statutory formula, for Federal employees covered by the locality pay system, the overall average pay increase would be about 15.0 percent.

Title 5, United States Code, authorizes me to implement an alternative locality pay plan if I view the adjustments that would otherwise take effect as inappropriate due to "national emergency or serious economic conditions affecting the general welfare." For the reasons described below, I have determined that it is appropriate to exercise my statutory alternative plan authority to set alternative January 2008 locality pay increases.

A national emergency, within the meaning of chapter 53 of title 5, has existed since September 11, 2001. Full statutory civilian pay increases would cost $16.4 billion in 2008 alone. That amount exceeds by $12.7 billion the cost of a 3.0 percent overall Federal civilian pay increase that I proposed in my 2008 Budget. Furthermore, the costs would grow at compounded rates in subsequent years. Such cost increases would force deep cuts in discretionary spending or Federal employment to stay within budget. Either outcome would unacceptably interfere with our Nation's ability to secure the homeland and pursue the war on terrorism.

Accordingly, I have determined that under the authority of section 5304a of title 5, United States Code, locality-based comparability payments for the locality pay areas established by the President's Pay Agent, in the amounts set forth in the attached table, shall become effective on the first day of the first applicable pay period beginning on or after January 1, 2008. When compared with the payments currently in effect, these comparability payments will increase the General Schedule payroll by about 0.5 percent. When combined with the 2.5 percent across-the-board increase, the 3.0 percent total increase equals the 12 month increase in overall nationwide labor costs as of September 2006 (the reference period for decisions about the January 2008 pay adjustment under current law). Our national situation precludes granting larger locality pay increases at this time.

Finally, the law requires that I include in this report an assessment of the impact of my decision on the Government's ability to recruit and retain well-qualified employees. I do not believe this decision will materially affect our ability to continue to attract and retain a quality Federal workforce. To the contrary, since any pay raise above the amount proposed in this alternative plan would likely be unfunded, agencies would have to absorb the additional cost and could have to freeze hiring to pay the higher rates. Moreover, the GS "quit" rate continues to be very low (2.1 percent on an annual basis), well below the overall average "quit" rate in private enterprise. Should the need arise, the Government has many compensation flexibilities, such as special salary rates and recruitment and retention incentives, to maintain the high quality workforce that serves our Nation.

The state's director of science curriculum has resigned after being accused of creating the appearance of bias against teaching intelligent design.

Chris Comer, who has been the Texas Education Agency's director of science curriculum for more than nine years, offered her resignation this month.

In documents obtained Wednesday through the Texas Public Information Act, agency officials said they recommended firing Comer for repeated acts of misconduct and insubordination. But Comer said she thinks political concerns about the teaching of creationism in schools were behind what she describes as a forced resignation.

Agency officials declined to comment, saying it was a personnel issue.

Comer was put on 30 days paid administrative leave shortly after she forwarded an e-mail in late October announcing a presentation being given by Barbara Forrest, author of "Inside Creationism's Trojan Horse," a book that says creationist politics are behind the movement to get intelligent design theory taught in public schools. Forrest was also a key witness in the Kitzmiller v. Dover case concerning the introduction of intelligent design in a Pennsylvania school district. Comer sent the e-mail to several individuals and a few online communities, saying, "FYI."

Agency officials cited the e-mail in a memo recommending her termination. They said forwarding the e-mail not only violated a directive for her not to communicate in writing or otherwise with anyone outside the agency regarding an upcoming science curriculum review, "it directly conflicts with her responsibilities as the Director of Science."

And we let the clown who ran that nut house of a state run our country for eight years, you get what you deserve in life. We apparently deserve the mess Crazy King George has created because “we” put him there.

Pregnant Woman's Tasering Probed

Redden, according to Etter, had come to the police station to ask police to take custody of her child. When officer Michael Wilmer asked why, the woman reportedly would only say that "she's tired of playing games" with the baby's father.

"At this point, they had a little more discussion that went nowhere," Etter said, recounting the incident. "She says, 'I'm leaving.'"

Etter, who repeatedly emphasized to ABC News that Wilmer had no idea the Valreca was pregnant, said that the officer then explained that she could not leave without further explanation. He took hold of the child with one arm, Etter said, and pushed the woman down with the other.

When a second officer arrived, Wilmer handed over the 1-year-old and attempted to handcuff Valreca. She began to resist, Etter said, at which point he "employed what is called a 'drive stun'" on the back of her neck.

The police today seem incapable of diffusing any situation without the use of a taser, I can just about assure you that had tasers been available in 1955 Rosa Parks would have been repeatedly “zapped” for a simple act of civil disobedience.

A scheme to train firefighters in major cities to look out for terrorists has raised fears that their iconic standing in American society could be damaged.



Unlike police, firemen and paramedics do not need warrants to get into homes and other buildings during technical inspections of emergency facilities, making them particularly useful for spotting signs of terrorist planning.

The Homeland Security Department has been secretly testing a pilot scheme in New York in which firefighters are trained to identify suspicious material or behavior. If successful, the program will be extended to other large cities.

However, the American Civil Liberties Union (ACLU) says that using firemen to gather intelligence is a step toward limiting people's privacy.

Since the September 11 attacks, Americans have given up some of their privacy rights in an effort to prevent future strikes.

The government monitors telephone calls and emails, and there is much more thorough searching of belongings at airports.

Mike German, a former FBI agent who is now the ACLU's national security policy adviser, said the latest measure was dangerously close to President George W Bush's proposal in 2002 to have workers with access to private homes - such as postal carriers and telephone repairmen - report suspicious behavior to the FBI.

He said that Americans "universally abhorred that idea", adding: "If in the conduct of doing their jobs they come across evidence of a crime, of course they should report that to the police. But you don't want them being intelligence agents." The plan would be particularly hazardous in communities already under police scrutiny, he said. "Do we want them to fear the fire department as well as the police?

"She used the PD as her personal taxi service," said one former city official who worked for Giuliani.

RICHMOND, Va. (AP) -- If you're planning to vote in Virginia's February Republican presidential primary, be prepared to sign an oath swearing your Republican loyalty.

The State Board of Elections on Monday approved a state Republican Party request to require all who apply for a GOP primary ballot first vow in writing that they'll vote for the party's presidential nominee next fall.

There's no practical way to enforce the oath.  Virginia doesn't require voters to register by party, and for years the state's Republicans have fretted that Democrats might meddle in their open primaries.

Virginia Democrats aren't seeking such an oath for their presidential primary, which is held the same day -- February 12th. (my bold)

With nary a peep from the main stream press, the House overwhelmingly passed H.R.1955 - Violent Radicalization and Homegrown Terrorism Prevention Act of 2007, with only 6 nay votes. Please watch this discussion about it with Amy Goodman on Democracy Now:

Many people are calling this the “thought crime bill”, and with good reason. This bill will criminalize dissent, and specifically targets the internet as the primary method of dissemination of such dissent. It will create a commission to study blogs such as this one, that question government policy. As one blogger states, “Simply put: If you’ve ever said that George W. Bush should be hanged as a war criminal, you sir, are a Terrorist.”

What is so frightening about this bill is that it was sponsored by Democrats, and pushed through with essentially no discussion. I read the news for hours every day, and just learned of it last week. There has been incredibly thorough analysis on blogs, but the major news outlets have been silent. This bill suspends the first amendment, and only three Democrats, including Dennis Kucinich, and three Republicans voted against it.

So I ask you, and perhaps I will end up in jail for saying so: How can we expect any change in this country without revolution, when the people we voted in for change perpetuate the same oppression as Bushco? Even the Republican led Congress didn’t have the gall to attempt this, yet our newly elected leaders didn’t even think it warranted discussion. The New York Times hasn’t done a story on it, nor the Washington Post. But this guy did. And so did she. And now there’s me, begging you to call your Senators and beg them not to pass this bill. Considering how things went down in the House, it’s probably a futile measure (hell, I have never once been able to even get through to Arlen Specter’s office) but at least you can say you tried, when you’re chatting with your buddies in the work camp.

Feds retreat on Amazon buyers’ identities

Subpoena pulled after ruling that protects book customers' privacy

U.S. prosecutors have withdrawn a subpoena seeking the identities of thousands of people who bought used books through online retailer Amazon.com Inc., newly unsealed court records show.

The withdrawal came after a judge ruled the customers have a right to keep their reading habits from the government.

"The (subpoena's) chilling effect on expressive e-commerce would frost keyboards across America," U.S. Magistrate Judge Stephen Crocker wrote in a June ruling.

"Well-founded or not, rumors of an Orwellian federal criminal investigation into the reading habits of Amazon's customers could frighten countless potential customers into canceling planned online book purchases," the judge wrote in a ruling he unsealed last week.

Amazon said in court documents it hopes Crocker's decision will make it more difficult for prosecutors to obtain records involving book purchases. Assistant U.S. Attorney John Vaudreuil said Tuesday he doubted the ruling would hamper legitimate investigations.

‘The subpoena is troubling’
Crocker — who unsealed documents detailing the showdown, against prosecutors' wishes — said he believed prosecutors were seeking the information for a legitimate purpose. But he said First Amendment concerns about freedom of speech were justified and outweighed the subpoena's law enforcement purpose.

"The subpoena is troubling because it permits the government to peek into the reading habits of specific individuals without their knowledge or permission," Crocker wrote. "It is an unsettling and un-American scenario to envision federal agents nosing through the reading lists of law-abiding citizens while hunting for evidence against somebody else."

The courts finally step up and support the Constitution. But the incredible thing is that our current Regime sees nothing wrong with going down this path, another example of why it is time for Regime change.

Former Private First Class Jordan Fox was injured by a roadside bomb in Iraq. He suffered a serious back injury, and he lost sight in his right eye.

A few short weeks after his honorable discharge from the Army, a letter came by mail from the Defense Department. Was it a letter informing him of local veterans' clinics where he could receive vocational rehabilitation or counseling? No. A signed "thank you for your service" from the Secretary of Defense, or perhaps the President? No.

It was a bill for nearly $3,000.

Since Fox was too severely injured to complete his military service, the Defense Department was demanding that he return part of his enlistment bonus. In the Army bureaucracy, his wounds didn't matter. The Army machine wanted its money back.

Sadly, he is not alone. Some troops seriously wounded in Iraq and Afghanistan are being denied their full enlistment bonus by the Pentagon, while others are being asked to return money they have already received.

In July, the Dole-Shalala Commission exposed the Department of Defense policy that prohibits bonuses from being paid in full to service members unless their entire military commitment is fulfilled. Wounded troops, unable to continue to serve, are forced into an early military discharge, and thus, can be denied their full bonus.

Romney and Giuliani Turn Negative in N.H. - Former Mayor Tries To Chip Away at Lead

Romney dramatically escalated the attacks Sunday with a salvo at Giuliani, who had earlier criticized him over a judicial appointee who had overruled a lower court and ordered the release of a convicted killer, who has since been charged with another killing. Romney has called on the judge to resign. With his wife, Ann, and other members of his family at his side, he said it is essential for Republicans to pick a nominee "who can distinguish himself on family values" from the Democratic front-runner, Sen.. Hillary Rodham Clinton (N.Y.).

He then proceeded to link Giuliani to Clinton on abortion, gay rights and immigration, and ended with tough words for the former mayor's support for former New York police commissioner Bernard B. Kerik to be secretary of homeland security. Kerik, a longtime friend and confidant of Giuliani's, was recently indicted on multiple corruption charges……

"I believe it's important for someone to be pro-life, to be pro-family and pro-traditional marriage, to be in favor of legal immigration but against illegal immigration and to have a record of insisting on the highest ethical standards, and I'm afraid that on all four of those measures that Mayor Giuliani would be the wrong course for our party," Romney said. "He is in the same position as Hillary Clinton on life and on marriage and on the ethical history of his administration, and also on sanctuary cities and immigration policy."

So if Mitt is going after Rudy and his infidelities and failed marriages does that make Mitt’s wacko religious beliefs fair game?

The major heresy of Mormonism is summed up in its central theological axiom, the doctrine of The Law of Eternal Progression. It is stated as follows: As Man is, God once was, and as God is, man may become."

Basically, it says that the god of Mormonism was once a man who was born to human parents on another planet, grew to manhood, lived out his life being obedient to the laws and ordinances of the gospel presented by the god of that world. Upon his death and resurrection, he was judged (by his god) as being worthy for godhood.

The Mormon god was raised to his godhood and sent with many goddess wives to a planet near the great star, Kolob, somewhere in our present galaxy. There, this god and his wives began ëprocreating' or physically begetting "spirit" children. We here on this planet are each the offspring of this god and one of his goddesses in this pre-existent Mormon world.

Amazing? Yes, it is! But even more disparate is the position of Christ in all this. Mormonism teaches that when their god decided it was time to populate this earth with his spirit children, the Head of All The Gods called a great council meeting to decide the method. The Mormon god asked his two eldest sons, Jesus and Lucifer, to both prepare plans for presentation to the council. They chose the plan of Jesus.

Lucifer rebelled and led one-third of the "children" to revolt against god and in a great battle, was defeated by Christ and the two-thirds who were "valiant." Lucifer and those who fought with him were cast to earth without bodies and became the devil and his demons. This coming week Wilkerson faces jury trial at the 15th District Court in Ann Arbor. Wilkerson's lawyers will bring in eyewitnesses to the events on November 30, 2006, plus expert witnesses including Brian Bledsoe, a Texas attorney who has testified in cases across the country on the use of ammonia. (Ammonia was involved in the death of Martin Lee Anderson at a juvenile 'boot camp' detention facility in Florida.)

Buck Davis tells me that "ten or fifteen years ago this case would have been a slam dunk, on First Amendment and medical privilege arguments, with no physical contact with the cops, all in liberal Ann Arbor." Wilkerson would have been swiftly acquitted.

"But now people are scared to death. They know the social system is falling apart. They no longer have a generous spirit. I've learned that the erosion of the economic and social fabric means people want to believe the cops. They're frightened. So I'm not as arrogant about 'slam dunk' cases as I once was."

File a report of Police Brutality and you will be charged with a felony, it is the way our Fascist state works now.

Opposition leader Garry Kasparov was detained by police Saturday after he and a couple of hundred supporters attempted to march on Russia's Central Election Commission following a rally in Moscow that drew several thousand people.

"They tried to push us back, but maybe then they got a new order, so they arrested us," said Kasparov, speaking to Echo Moskvy radio from a bus where he was being held. "I saw them beating people."

Meanwhile, a candidate in next Sunday's parliamentary elections from the small Yabloko party died Saturday from wounds sustained when he was shot four times outside his home Wednesday in the southern republic of Dagestan
